It’s all about the kids!
The underlying premise of every child custody case is what is in the best interest of the children. Child custody is not about what is in your best interest. Child custody is not about what is in the other parent’s best interest. The sole consideration of most judges is how to arrange a timeshare for the children that will allow them to thrive. When you are preparing your case or discussing it with me, please keep this basic premise in mind. You are much more likely to prevail in your custody case if you show the court through your words and actions that your main concern is making this transition easy on the kids and making them happy!

The court will decide what is in the best interest of your children based on evidence and facts presented in the pleadings (written paperwork) and testimony of witnesses. The more information you can provide, the more persuasive I can be with the judge. It will help your case if you can give me a detailed factual narrative about what you think is in the children’s best interest and why. Talk about how you, the other parent, and other people (family members, teachers, child care providers, etc.) interact with the children and how such interaction helps or hurts them. Give me evidence to back that up. Letters (with a notary stamp on them) from third parties who have seen both of your parents the children are helpful. Report cards, other school records, photographs, and any other relevant documents will assist me in obtaining a favorable resolution for you.
Communicate in writing.
If the other parent is being a jerk, do not respond by being a jerk yourself! All-day long, day after day, the judge sees parents who spew venom and hatred at one another. If you can show written communication where you are reasonable and polite even if the other party is insulting, the judge will really like that. Communicate by email so you can show that the other party is more concerned about being rude to you than they are about the best interest of the children. The judge will understand who the better parent is. Protect your kids from the discord between the two of you.
