Hard to believe, but No-Fault divorces are almost 100 years old. Until the early 1930s, people wishing to end their marriages needed a legitimate and often specific “fault” to file for divorce—adultery, spousal abuse, substance abuse, or some other reason. Whatever the fault, it had to be provable in a court of law. Clearly this was not always easy to do and sometimes expensive.

Las Vegas became one of the first places to enable people to pursue a divorce route known as No Fault. Many divorcees, Californians especially, among them many famous people, found No Fault an attractive option and would move to Nevada to spend the required number of weeks before filing. No Fault made for a much quicker divorce than the regular process. In all the decades since, the No Fault option remains a selling point of Nevada but also exists in many other states.

Here are some answers to common questions I get about No Fault divorces:

How much does it cost to get a No Fault divorce in Nevada? Regardless of what type of divorce you want, the Nevada district court charges a filing fee of about $300. You can, of course, file for divorce yourself, but I strongly caution you against that strategy. Even if you and your ex-partner press forward without problems and getting along, drawing up a divorce decree on your own is dangerous. Many things can happen down the road that will be much easier if you let a professional attorney handle them for you, like: child custody rights, child support, alimony, and hidden assets. Can you fight a No Fault divorce? No. Your spouse can draw out the process and fight, but in Nevada a judge will grant a divorce over the objection of one partner. 

How will a No Fault divorce affect my rights to my children? The Nevada Revised Statutes, NRS 125C, layout custody and visitation. Your relationship with your children should be the most important one in your life. Trying to negotiate custody, visitation, and child support on a form downloaded from the Internet is not a wise decision. I will make sure you get everything you need to raise your children in a financially secure environment if you are due support, and if you owe support I will make sure you pay what is fair. How long does No Fault divorce take? In a smooth process where the spouses get along and agree on major issues, like asset division, a No Fault divorce can take two months. Even though your spouse cannot stop you from winning a divorce decree, as mentioned in the question above, contesting the process will add time to the final judgment. 

Will I still have to pay alimony in a No Fault divorce? Maybe. In Nevada, alimony, or spousal support, is awarded at the discretion of a judge. If necessary, we can file during the divorce process, known as alimony pendente lite.
