The Nevada Revised Statues (NRS) provide clear definitions of the crime of Burglary, NRS 205.060. Essentially, if you enter any structure, including a tent, airplane, or boat, with the intent to obtain money or property, you have committed Burglary. If this is a first offense, we will do our best to keep your penalty to a minimum. Naturally there are many different circumstances for this crime, including conspiracy or if any violence occurred. Penalties can rise and fall based upon what happened, but generally a Burglary 1st degree crime carries a felony category and comes with mandatory minimum prison time. If this is a second offense, that will change our strategy. A previous conviction means you will be held without bail. It’s possible you entered a commercial establishment during business hours. If so, we can shift our strategy in a different direction based upon the specifics of the crime.
Burglary with a firearm changes the dynamics of the case. Possessing a gun during a crime always increases the penalty, but there are ways we can try not to let a firearm possession affect your sentencing too much. Obviously, as I mentioned above, if violence occurred during the burglary, that will further change our strategy. Each crime is different.
Home invasions have been on the rise in southern Nevada. A home invasion carries similar penalties to Burglary. If you forcibly enter someone’s home you may be charged with home invasion. The NRS has specific language about home invasions and municipalities have been actively prosecuting these crimes. Again, if a firearm was used in the invasion, that will change potential penalties as well as our strategy. There may be many reasons why entering a home unlawfully happened, including domestic disputes with a former partner. We may be able to mitigate the damage and get a lesser sentence for you.
